The Colorado rules that override a national shortcut
Use the following contrasts as retrieval prompts rather than as isolated slogans.
Title The legal ownership interest or rights in property, distinct from the deed documenting transfer. See Chapter 7. Glossary and licensing. Colorado's ordinary entry-level License In property use, permission distinct from an estate; in professional regulation, authorization to practice. See Chapter 5, Chapter 19. Glossary is Associate broker A Colorado broker practicing under an employing broker; not a separate salesperson license category. Glossary; passing does not itself authorize practice. Independent and employing status are separate qualifications. CO03
Relationships. Colorado prohibits Dual agency Representation of opposing parties in the same transaction where legally permitted. See Chapter 8. Glossary and subagency. Designated brokers in one firm are not automatically one dual agent. As of the verified August 2026 amendment, both single Agency An authorized relationship in which an agent acts on behalf of a principal. See Chapter 8. Glossary and transaction-brokerage require the statutory written agreement before covered brokerage activities. CO09 CO24
Contracts. The current residential form's default Deed An instrument used to convey an interest in real estate. See Chapter 7. Glossary is special warranty, its default day ends at 11:59 p.m. Mountain Time, and its weekend extension is not automatic. Form selection and completed terms matter. CO11
Money. Distinguish three-business-day ordinary deposits from five-business-day property-management deposits, each measured from the applicable later event. Reconcile monthly and preserve the four-year required records. CO06 CO20
Property management. The amended standard tenant security-deposit return period is 30 days, subject to an agreed extension no longer than 60 days. It is not a trust-deposit deadline. CO14
Water and Foreclosure Enforcement of a security interest through authorized sale or legal process. See Chapter 7. Glossary. Land beside water is not unlimited diversion authority; a permit change is not automatically a use change. Cure and Redemption Recovery of property or relief from enforcement by satisfying applicable obligations within an allowed period. See Chapter 7. Glossary are different stages with different eligible parties. CO23 CO21
A transaction from first contact to closing
A seller hires you to market a residence with a leased solar system, a domestic well, an association, and a tenant. Before listing, identify the lawful brokerage relationship and execute the required agreement. Clarify compensation. Obtain authority to market and identify known Material fact Information significant to a transaction decision under the applicable legal standard. See Chapter 12. Glossary without claiming expertise you lack.
Before advertising, verify the information source for square footage, occupancy, water, inclusions, solar obligations, and other factual claims. The tenant's privacy and lawful access rights must fit the showing plan. A team name does not replace required brokerage identification.
When a buyer approaches, determine whether you remain the seller's single agent with the buyer as Customer A person receiving services without necessarily being represented. See Chapter 8. Glossary, or whether a lawful documented change is being considered. Do not become a secret buyer advocate while retaining seller Agency An authorized relationship in which an agent acts on behalf of a principal. See Chapter 8. Glossary. Handle confidential information according to the relationship and supervision rules.
At the offer stage, choose the appropriate form and complete meaningful deadlines. Distinguish leased solar obligations from owned Fixture An item formerly personal property treated as part of the real estate under the applicable analysis. See Chapter 2. Glossary, water rights from the well hardware, and ownership from possession. Explain the buyer's proposed conditions to the seller without promising that financing or third-party approvals are guaranteed.
After agreement, deliver and account for earnest money, communicate notices, track inspection and Title The legal ownership interest or rights in property, distinct from the deed documenting transfer. See Chapter 7. Glossary processes, obtain appropriate specialist help, and avoid using an objection as though it were a termination. Review association materials, lease documents, deposit transfers, well paperwork, and approvals.
At closing, compare the Deed An instrument used to convey an interest in real estate. See Chapter 7. Glossary and settlement with the contract. Check tax and rent Proration Allocation of a recurring amount between parties or periods. See Chapter 17. Glossary, tenant deposits, payoff and release arrangements, compensation, and any required withholding. Confirm the possession arrangement. Preserve the required records and confidentiality after the money moves.
This scenario is not an extra set of legal rules. It is a method for applying the chapters together. The important questions are who owes the duty, which document controls, what fact triggers it, and what must happen next.
Twelve short drills
Write answers before reading the key.
Drill 1. An unlicensed person passes both broker exam portions this morning. May the person begin negotiating for a Client A represented principal in a brokerage relationship. See Chapter 8. Glossary this afternoon solely on that basis?
Drill 2. A broker plans transaction-brokerage and says no written engagement is needed because the broker is not an agent. Apply the August 2026 rule.
Drill 3. A buyer pays the brokerage fee. Does that fact alone establish buyer Agency An authorized relationship in which an agent acts on behalf of a principal. See Chapter 8. Glossary?
Drill 4. A CBS1 The Commission’s residential Contract to Buy and Sell Real Estate form designation. Use the applicable revision and the actual completed terms. Glossary objection deadline falls Sunday and neither extension box is checked. Is Monday automatically timely?
Drill 5. A CBS1 contract selects no alternative Deed An instrument used to convey an interest in real estate. See Chapter 7. Glossary. What is the form's default deed?
Drill 6. An Inspection objection A contract notice identifying inspection-related dissatisfaction through the agreement’s objection route; distinct from the separate termination route. Glossary has been delivered. The buyer now wishes to proceed despite no seller repair agreement. What must the broker consider before the resolution deadline?
Drill 7. Purchase funds are received Monday, MEC is Wednesday, and there are no holidays. Under the stated three-business-day deposit rule, what is the outside deposit day?
Drill 8. All trust totals reconcile, but one owner's ledger is negative. Is the account necessarily compliant?
Drill 9. A covered nonresident sale is $450,000 and net proceeds are $6,500. What is the lesser-of withholding amount, assuming no exception?
Drill 10. The owner updates contact information for an existing well permit. Which cited statute uses 63 days, rather than the residential form's separate 60-day no-closing-service provision?
Drill 11. A lease with no longer return period ends and the premises are surrendered June 1, 2026. Which standard security-deposit interval applies?
Drill 12. A seller collected $2,400 rent for a 30-day month. Closing is the 16th and the buyer gets the closing day. State the Proration Allocation of a recurring amount between parties or periods. See Chapter 17. Glossary amount and direction.
Drill key

How to finish preparation
Read the national chapters and solve national math, but give Colorado forms and closing their own study sessions. Work directly through a blank current residential contract and the relevant brokerage agreement. Reconstruct the deadline, representation, and trust rules from memory, then check your wording against the sources.
Take the original Colorado examination in Chapter 37 for 110 minutes without the answer chapter. Review every error and every guess. The exam follows the published category counts, but neither a passing practice score nor this book provides a guarantee about a live examination.
Finally, verify the current PSI bulletin, Division application instructions, consolidated rules, adopted forms, and recent legislative updates. For a question explicitly tied to a historical form or effective date, answer the stated version. For real practice, do not continue using superseded rules merely because they appear in an older flashcard set.
